    COULD THIS BE DONE TO SUPERCEDE THE FLAT RATE STATE PENSION LOSSES AS WELL AS THE RAISED RETIREMENT AGE?

    So this… issue of an SI giving 28 days notice…
    could this be done to pay within 5 weeks of the notice’s issue:
    Pay women their state pension this year women aged 60 to 67 not yet in receipt of a state pension this year, in full for 30 years National Insurance contribution / credit history (and pro rata for the rest)?

    HOW WOULD THE POOREST WORKERS AND HOUSEWIFE’S STATE PENSION BE SAVED BY SI NOTICE PLEASE?

    Could an SI notice somehow supercede all the people who lose all state pension by the changes of the Pension Bill 2014 (flat rate state pension 2016) please?

    HOW COULD THE SERPS OPT OUT BE SEPARATED FROM THE BASIC STATE PENSION AMOUNT BY THIS SI NOTICE?

    Right now the full basic state pension is £113.10 per week.
    But each year you were opted out of SERPs reduces your National Insurance record by a year.

    The basic state pension this year is not effected by the SERPs opt out, as it is a top up to the basic state pension, not a means to reduce the basic state pension as coming with the flat rate state pension.

    If we had not been opted out, what we would have gained this year with 30 years NI record and 30 years in SERPS is £278.10 per week.

    Now we cannot get something we were opted out from, of course.

    But could the SI notice beused to pay the £113.10 per week state pension for 30 years National Insurance record this year to men and women, please?

    STATE PENSION IS SOLE PENSION PROVISION FOR MILLIONS OF MEN AND WOMEN

    This is vital food and fuel money in old age, as for many is the only pension provision.

    For the rest, the average low waged works pension is more like £400 per month for a man and half that for a woman.

    The money experts say pensioners need an average of £10,000 per year to pay their raised energy bills and other costs.

    Example is that over 75s, on average, have less capability to generate their own body heat, and so need to heat one room 24/7 to 70F. Impossible for most people.

    OFFER ANY HOPE TO ALL THOSE FACING NIL STATE PENSION FOR LIFE

    TUSC (Trade Unionist and Socialist Coalition) offers to
    Reverse the rise in retirement age and to pay a decent state pension.
    The 6th biggest party in the UK, you’ve never heard of.

    CLASS WAR offers double dole and pension.

    RESPECT offers state pension at 60 for men and women.

    But the older voter depends on the television to learn about candidates and these parties are entirely missing from national media.

    The excuse stated is that they do not have (save RESPECT) an MP yet.

    The Labour party began at the turn of the 20th Century from the 19th and did not have a government til 1924.

    YOUR ANSWER MIGHT HELP ME TO HELP OTHER PETITIONS ON THE STATE PENSION, NOT ONLY MY OWN

    The SNP are on course to win all 59 Scottish seats. They will be kingmakers as needed by Labour to vote against a TORY QUEEN’S SPEECH so stopping them from remainining in power as a caretaker government, even if get less seats than Labour.

    The SNP say they will stop any further rise in the retirement age in the whole of the UK.

    If this SI notice thing can be used to supercede the loss of the state pension to so many, then maybe the SNP could do this for us in May?

  3. CAN THIS BE DONE FOR THE STATE PENSION?

    The flat rate state pension merged SERPs and the basic state pension, meaning nil state pension for huge numbers of men and women retiring next year onwards from 6 April 2016.

    The flat rate pension also wipes out a variety of state pension claimants for life by pensionc hanges.

    RE THE SI GIVING 28 DAYS NOTICE
    …The simple fact is Labour has no legal need to go down the primary legislation route. It can issue a SI giving 28 days notice and that is the end of it in 5 weeks time after the election. So why legislate?

    5 weeks time would see a need for 5 weeks worth of DHP for all 465,55i households affected – about £37 million or so – and the current coalition has given LAs £60 million to mitigate the bedroom tax for 2015/16 thus using the SI route would not cost the incoming Labour government a penny. The DHP money is already there!

    YET

    Primary legislation could take 6 months or 2 years to push through and so would involve 6 months to 2 years worth of DHP to mitigate or £188m to £800 million and so that is the additional cost to the taxpayer of this truly bizarre route of primary legislation.
    Of course all primary legislation can fail and be voted down or given the likely tenuous nature of the post May general election we could be seeing a second general election this year or early next year just as we had in 1974.
    If either of those two events happen then the bedroom tax remains. …

    SUPERCEDING PENSION BILLS 2010-2014 (FLAT RATE STATE PENSION 2016)?

    NEXT GOVERNMENT CANNOT ACHIEVE PRIMARY LEGISLATION
    AS WILL BE A MINORITY / SEVERE HUNG PARLIAMENT

    326 MP minimum threshold to form a UK parliament.

    Neither Tories nor Labour will reach anything like that number of MPs in the UK government.

    So primary legislation cannot succeed, as the Tories would make sure anything to do with reversing welfare cuts like Bedroom Tax fails.

    FUNDING NEUTRAL
    This would cost nothing as the National Insurance Fund is in surplus since 2013 because of the non-payout to women at 60 from 2013 and the rise from 65 to 66 for men also from 2013.

    LABOUR / LIB DEM / TORY / UKIP / THE GREENS
    All these parties fail to grant huge numbers of men and women any state pension for life from the flat rate state pension.

    The Greens did have policies to end all the cruelty of benefit cuts and to pay a flat rate state pension irregardless of National Insurance history, that would have ended the coming penniless starvation of all ages.

    But The Greens ditched those policies in the interview of Ms Lucas on BBC Four.
